By utilizing Bulki.ai's Beta Services, you agree to abide by these terms and to adhere to the Bulki Terms of Service, Product Specific Terms, Privacy Policy, and Acceptable Use Policy, all of which are hereby incorporated by reference. Your continued use of any Bulki service, including Beta Services, is subject to these overarching terms.

Nothing in this agreement shall be construed to create a partnership, joint venture, agency, or employment relationship between you and Bulki.ai. Each party remains an independent entity, and no provisions in this agreement are intended to create or be interpreted as creating any form of legal association that would impose liability on one party for the act or failure to act of the other.
You agree to provide constructive feedback regarding your experiences with the Beta Services, granting Bulki an irrevocable, perpetual, royalty-free license to use this feedback in any manner, including for product development and marketing purposes, without any obligation to you.
All intellectual property rights in and to the Services, including any derivatives, improvements, enhancements, or modifications thereof, are owned by Bulki, LLC. By using the Services, you do not acquire any ownership rights to the Services or any related intellectual property.
With your prior written consent, Bulki may use your name, logo, and a mutually agreed upon statement about your use of the Beta Services for promotional purposes. Participation in the Beta Program does not require granting these Publicity Rights.
You agree to treat all non-public information received through your participation in the Beta Program as confidential, maintaining secrecy unless such information becomes public through no fault of your own.
These terms become effective upon your acceptance and remain in effect until terminated by either party with thirty days' notice. Your right to access specific Beta Services begins upon availability and ends upon general release or earlier termination notice from either party.
Bulki, LLC. reserves the right to modify these terms at any time. Notice of significant changes will be sent to the email associated with your account or communicated through the service interface. Continued use of the Beta Services after changes have taken effect constitutes acceptance of the new terms.
Either party may terminate your participation in the Beta Program at any time and for any reason. Bulki, LLC. may do so with or without prior notice to you. Upon termination:
As a participant in our Beta Service program, you agree to maintain the confidentiality of your experience and any information related to the Beta Services. This includes refraining from publishing reviews, comments, or any form of public feedback online without prior written consent from Bulki, LLC. The Beta Services are in a testing phase, and premature public commentary can lead to misinformation and affect the perception of our products. If you have feedback, concerns, or comments about the services, please direct them to support@bulki.ai so we can address them appropriately within the scope of the Beta Program.
Beta Services are provided "AS-IS" without warranty regarding performance, speed, functionality, support, or availability. Bulki assumes no liability for any harm or damage resulting from service deficiencies.
You agree to comply with all applicable laws and regulations in your use of the Beta Services, including but not limited to data protection and privacy laws.
Bulki will not be liable for indirect, incidental, special, consequential or punitive damages related to these terms or the Beta Services, regardless of the cause of action. Notwithstanding the foregoing, Bulki's total liability for any claim under these terms, whether in contract, tort, or otherwise, is limited to the amount actually paid by the user for the Beta Services in the 30 days prior to the claim.
Bulki, LLC. may periodically update or modify the Beta Services automatically to improve performance, enhance functionality, or ensure security, without prior notice. We will endeavor to inform you of any significant changes that could materially affect your use of the Beta Services. As these updates are automatic, you will receive the latest version of the Beta Services whenever you access the platform. This ensures that you always benefit from the most current features and security enhancements. Your continued use of the Beta Services after such updates will constitute your acceptance of these changes.
Our Service may contain links to third-party web sites or services that are not owned or controlled by the Company.
The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Beta Terms and Conditions or our Terms and Conditions.
Upon termination, Your right to use the Service will cease immediately.
Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You for the Services in the 30 days prior to the claim or $0.00 USD if You haven't purchased anything through the Service.
To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

You represent and warrant that (i) You are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a "terrorist supporting" country, and (ii) You are not listed on any United States government list of prohibited or restricted parties.
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.
